IOM3 Event Terms & Conditions (Feb 2021)

IOM3 reserves the right to amend these terms and conditions from time to time. However, you will be subject to the terms and conditions in force at the time you submit your registration.

Implied Agreement
These are the terms and conditions (the “Agreement”) governing your participation in any virtual or in-person event meeting, show, seminar or conference (the “Virtual Event” or “Event”) owned or operated by The Institute of Materials, Minerals and Mining or its subsidiaries IOM Communications Ltd and MIS Ltd (collectively, “IOM3”).   By registering for the Virtual Event, you agree to these terms which form a binding legal contract between the Virtual Event owner and host, IOM3 (“Owner and Organiser” or “We”), and the registered participant (“you” or “Participant”).    If you are registering on behalf of another individual, it is your responsibility to ensure the person participating is aware of these terms and accepts them. By completing the registration on behalf of another individual you are warranting that you have made the Participant aware of these terms and that they have accepted these terms.

Participant Requirements

Cost of Access – Your registration entitles you to access to the Event or Virtual Event for which you have registered.   Any and all other costs associated with your attendance shall be borne solely by you, and IOM3 shall have no liability for such costs.  Registration fees do not include insurance of any kind.  It is strongly recommended that at the time of booking the conference registration and associated arrangements you take out appropriate insurance to cover any losses incurred.  

Payment - Payment of any registration fees must be settled in full prior to attending the Event, otherwise admission may not be granted.   All registration details, including payment details, will be processed via a secure server.

Value Added Tax (VAT) where applicable will be added at the prevailing rate to fees.  For in-person events the VAT applicable at the point of supply is payable by all delegates regardless of the delegate’s location.   For IOM3 virtual events, UK VAT is payable by the UK and overseas delegates. Where an overseas organisation pays registration fees on behalf of the delegate, VAT is charged in accordance with the current UK VAT legislation (2021 – outside the scope), provided all relevant company/organisation details are supplied.

Registration Cancellation and Substitution – Cancellations must be notified in writing to [email protected].  Telephone cancellations will not be accepted. 

Registration fee refund policy

Up to and including 60 days prior to the event  refund less £20 administration charge
59-14 days prior to event refund less £20 or 20% administration charge (whichever is greater)
Less than 14 days prior to event (or if the Participant fails to attend the event) no refund


Substitutions with employees from your organisation are welcome at any time but in all other respects delegate registrations are issued for your personal use only and cannot be shared with any person during the Event. You must email any substitutions to [email protected]  prior to the date of the Event.  For the avoidance of doubt telephone substitutions are not accepted.   Non-members attending in place of IOM3 Members will be charged the difference in fee.

Use of Participant Contact Information – IOM3 will process the personal data you provide to us under this Agreement in accordance with our Privacy Policy.       

By registering for an IOM3 event, or accepting a ticket, you give permission to be sent information about the Event or future IOM3 events on a relevant topic.

By registering for the Event, you give permission for your name, job title, organisation and country to be shared with other attendees, associated third‐party vendors and event sponsors.    Participants will be featured in the event app and networking tool with the Participant’s name, job title and company visible to all other attendees, speakers, exhibitors and sponsors.   Messages and meeting requests can be sent via the event app platform.  Participants can switch off this feature on their event app profile.  More information is available from [email protected].   

In addition, the Participant’s email addresses will be shared with event sponsors.  If you would like to opt‐out, a written request must be sent to [email protected].  

At Virtual Events, participant engagement data is collected and shared with sponsors and exhibitors.   Virtual exhibition stands may use lead generation and contact forms.   If you would like to opt‐out, a written request must be sent to [email protected].   

The Attendee List may not be reproduced, copied or disseminated, entered into a computer database, used as part of or in conjunction with a mailing list, or otherwise utilised except for your individual, personal and confidential reference. Use of the data in the Attendee List to send unsolicited marketing e‐mails (“spam”) is not permitted. Infractions are policed and may result in legal action. 

Use of Likeness – By participating in an IOM3 Event, you acknowledge and agree to grant IOM3 the right to record, film, live stream, photograph, or capture your likeness in any media now available or hereafter developed and to distribute, broadcast, use, or otherwise globally to disseminate, in perpetuity, such media without any further approval from you or any payment to you. This grant to IOM3 includes, but is not limited to, the right to edit such media, the right to use the media alone or together with other information, and the right to allow others to use or disseminate the media.

 

 

Prohibitive Conduct

Limitations on Use – By registering for a Virtual Event, you agree not to sell, trade, transfer, or share your complimentary access link unless such transfer is granted by IOM3. If IOM3 determines that you have violated this policy, IOM3 may cancel your access, retain any payments made by you, cancel your membership, and ban you from future IOM3 virtual and live events.  

Recording & Broadcasting – You may not record or broadcast audio or video of sessions of IOM3 Virtual Events. You may not record any one‐on‐one meetings, group discussions, virtual networking, or any other activity with other attendees without prior written consent from all other participants in the conversation.

Competition (Antitrust) Law - Our goal is to have a productive conference.  However our attendees represent a large variety of companies, many of whom compete with one another. You are therefore reminded that you should comply with Competition Law.

In particular, you must not formally or informally discuss, exchange information or reach any agreement with employees of competing companies on the following points:

  • Including individual company prices, price changes, payment terms, discounts or terms and conditions of the agreements.
  • Individual company production plans, capacity issues or changes in production, profit margins, market strategies or investment plans.
  • Individual company bids or contracts.
  • Matters relating the current or potential suppliers, contractors or customers.
  • Rate policies or market allocation.

If any formal or informal conversation raises concerns relevant to the above, participants should end or postpone the discussion until after the advice has been sought. All participants are reminded to promptly object and alert the Organiser to any material, presentation, question, comment or the like that they do not believe is appropriate for this conference.

Code of Conduct (Discriminatory Behaviour) – By registering and participating at an IOM3 Event or Virtual Event, you agree to abide by the IOM Events Code of Conduct. 

IOM3 is dedicated to providing a harassment-free conference experience for everyone, regardless of sex, gender identity, sexual orientation, marital or parental status, age, disability, race, religion or physical appearance. We will not tolerate harassment of conference participants in any form. All communication should be appropriate for a professional audience including people of many different backgrounds. Sexual language and imagery are not appropriate for any conference venue, including talks. Be kind to others. Do not insult or put down other attendees. Behave professionally. Remember that harassment and sexist, racist, ableist or other exclusionary jokes are not appropriate for IOM3 Events and Virtual Events.   Participants violating these rules may be asked to leave the conference, without a refund, at the sole discretion the IOM3 team.  Read full Code of Conduct.  

Amendment, Cancellation and Payment

Event Amendment – You acknowledge and agree that IOM3, in its sole discretion, reserves the right at any time and for any reason to change any and all aspects of the Event, including but not limited to, the Event name, themes, content, program, speakers, performers, hosts, moderators, venue, format and time without liability.  

Event Cancellation - In the unlikely event that IOM3 must cancel the event, we will refund any registration fee paid.

Force Majeure – Circumstances which are beyond the reasonable control of IOM3 and which are reasonably likely to affect successful delivery of the Event or would make it inadvisable, impracticable, illegal, or impossible for a party to perform its obligations as originally contracted under this Agreement, including: fire, flood, earthquake, extreme adverse weather conditions, failure of electric power, gas, water, or other utility service, collapse of building structures, widespread disease or other public health emergency (including pandemic or epidemic), strike or other industrial action, the outbreak or declaration of war, act of terrorism, revolution or government orders or action (including the declaration of a State of Emergency or Coup d’état).

Where a Force Majeure Event has or may have (in the sole discretion of IOM3) an adverse impact on: (i) the ability of IOM3 to hold the Event at the planned venue or on the planned date; or (ii) the Event generally, then IOM3 shall be entitled but not obliged (in its sole discretion) to either: (i) provide alternative facilities or venue for the Event; and/or (ii) reschedule the Event. Any of your fees received by IOM3 shall be applied to any rearranged or rescheduled Event held pursuant to this condition and you shall not be entitled to object to such rearranged or rescheduled Event or have any right to claim any compensation in respect thereof. If IOM3 is unable or elects not to rearrange or reschedule the Event pursuant to this condition, then you will (as its sole remedy) be entitled, in your sole discretion, to receive either a refund or credit note in respect of your fees received by IOM3, in each case less an administration charge equivalent to no more than 10% per cent of the total amount of your fees (which IOM3 may (in its sole discretion) either deduct from any refund or credit note or invoice). These terms and conditions shall apply in respect of any rearranged or rescheduled Event organised by IOM3 pursuant to this condition.
