We all think 'it’ll never happen to me' but clearly it can. This event will provide delegates with an insight into how an incident is viewed from all sides and will go through the events, immediate aftermath, investigation by the Enforcement Authority and show how and why these events can end in a criminal court proceedings.
The Seminar will include presentations and practical demonstrations including interview under caution, preliminary hearings and case for the prosecution and defence. Delegates will be taken through each step from the incident itself to a Crown Court Trial and after each step will be asked 'what happens next?' before the legal team presents the most probable outcome.
The day will include extracts from a mock trial with real lawyers for the defence and prosecution cross-examining real witnesses. A 'judge' will sum up and delegates will be asked for their views as to the likely verdict before any sentence is passed.
This event is designed to provide an insight into the likely operational, reputational and legal issues following a major safety incident and provide an understanding of the potential ramifications including how companies and individuals seek to defend themselves, and how a case is brought to a trial in the Crown Court.
Attending this event will help you understand:- The recent developments in corporate and personal liability brought about by the Corporate Manslaughter & Corporate Homicide Act 2007 and the Health & Safety (Offences) Act 2008. Both companies and individuals need to be aware of the potential implications of any incident.
